1. Acceptance of Terms

By accessing or using the Verity Index platform ("Service"), operated by HotChili Analytics, LLC ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Verity Index is an AI-powered video verification platform that analyzes YouTube video content for truthfulness and factual accuracy. The Service processes publicly available YouTube video transcripts using artificial intelligence and returns fact-checking reports. The backend analysis engine ("VerityNgn") is available as open-source software at github.com/hotchilianalytics/verityngn-oss.

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete registration information
  • Maintain and promptly update your account information
  • Maintain the security of your password and accept all risks of unauthorized access
  • Notify us immediately if you discover any unauthorized use of your account

You are responsible for all activity that occurs under your account.

4. Subscription Plans and Payment

The Service offers various subscription tiers (Free, Starter, Team, and Enterprise) with different usage limits and features. Paid subscriptions are billed through Stripe, our third-party payment processor. By subscribing to a paid plan, you agree to:

  • Pay all fees associated with your chosen plan
  • Authorize recurring charges at the applicable billing interval
  • Understand that subscription fees are non-refundable except as required by law

You may cancel your subscription at any time. Upon cancellation, your access to paid features will continue until the end of your current billing period, after which your account will revert to the Free tier.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Submit content that infringes on the intellectual property rights of others
  • Attempt to circumvent usage limits, rate limits, or access controls
  • Use automated scripts or bots to interact with the Service beyond its intended API
  • Interfere with or disrupt the integrity or performance of the Service
  • Reverse-engineer, decompile, or disassemble any part of the Service (except as permitted by the open-source license for VerityNgn)
  • Resell, redistribute, or sublicense access to the Service without written consent

6. AI-Generated Content Disclaimer

The reports and analyses generated by the Service are produced by artificial intelligence models and are provided for informational purposes only. AI-generated content may contain inaccuracies, errors, or omissions. You acknowledge and agree that:

  • AI-generated reports are not a substitute for professional fact-checking, journalistic verification, or legal advice
  • The Company does not guarantee the accuracy, completeness, or reliability of any AI-generated analysis
  • You are solely responsible for how you use or rely upon the information provided by the Service
  • Truthfulness scores and claim assessments represent the AI's analysis and should not be treated as definitive statements of fact

7. Intellectual Property

The Service, including its design, features, and branding (excluding open-source components), is the property of HotChili Analytics, LLC. The VerityNgn analysis engine is released under an open-source license as described in its repository. You retain ownership of any content you submit to the Service, but grant us a limited license to process it for the purpose of providing the Service.

8. Third-Party Services

The Service integrates with and relies upon third-party services, including but not limited to:

  • YouTube / Google: For accessing publicly available video content and transcripts
  • Stripe: For payment processing and subscription management
  • Google Cloud Platform: For infrastructure, AI model hosting, and data processing

Your use of the Service is also subject to the terms and policies of these third-party services. We are not responsible for the availability, accuracy, or conduct of third-party services.

9. Data Retention

Report retention periods vary by subscription tier. Free tier reports are retained for 7 days, Starter tier for 90 days, Team tier for 1 year, and Enterprise tier reports are retained indefinitely. We reserve the right to delete data associated with inactive accounts after 12 months of inactivity.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOTCHILI ANALYTICS, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, WHETHER IN AN ACTION IN CONTRACT, TORT, OR OTHERWISE, ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless HotChili Analytics, LLC, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service or your violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership, warranty disclaimers, limitation of liability, and indemnification.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the Service or via email. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
